These Terms govern your access to and use of maltabusinessjournal.com and the newsletters, accounts, comments, events, promotions, content and other services that link to them. Please read them together with our Privacy Policy, Cookie Policy and Ethical Standards.
1. About us
Malta Business Journal is operated and published by the legal entity identified in the website footer and Contact page. In these Terms, ‘MBJ’, ‘we’, ‘us’ and ‘our’ refer to that operator; ‘Service’ means the website and any related service that links to these Terms; and ‘you’ means the person using the Service.
2. Acceptance and eligibility
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organisation, you confirm that you are authorised to bind that organisation.
The Service is not directed to children under 13. You must be at least 18 to purchase a service, enter a contract, submit commercial content or act for an organisation unless applicable law and the relevant specific terms permit otherwise.
3. Changes to the Terms
We may update these Terms to reflect changes to the Service, our business or applicable law. The current version and review date will appear on this page. Material changes apply prospectively and will be notified through a reasonable channel where required. Continued use after a change takes effect constitutes acceptance to the extent permitted by law.
4. Accounts
Some features may require an account. You must provide accurate information, keep it current, protect your credentials and notify us promptly of suspected unauthorised access. You are responsible for activity carried out through your account unless caused by our failure to use reasonable care. We may require verification, reject a username or close duplicate, fraudulent, inactive or compromised accounts.
5. MBJ content and intellectual property
The Service and its articles, design, branding, databases, photographs, video, audio, graphics, newsletters and other material are owned by or licensed to MBJ and are protected by copyright, trade mark, database and other laws.
We grant you a limited, revocable, non-exclusive, non-transferable licence to access the Service for lawful personal or internal business reading. You may share a link and quote a short, reasonable extract with clear attribution where permitted by law. You may not reproduce, republish, sell, syndicate, frame, mirror, remove attribution from or create a competing database from our content without written permission.
To the fullest extent permitted by law, MBJ expressly reserves its rights in relation to text and data mining, automated extraction, dataset creation and the training or development of artificial-intelligence or machine-learning systems. Permission must be obtained unless an applicable mandatory exception clearly permits the intended use. Machine-readable reservations on the Service form part of this notice.
6. User contributions
If we allow comments, profiles, submissions or other contributions, you retain ownership of material you own. You grant MBJ a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, edit for style or safety, display, publish, distribute and promote the contribution in connection with the Service and our owned channels. The licence lasts for as long as reasonably needed to operate the Service, maintain the archive and exercise or defend legal rights.
You confirm that you have the rights and permissions needed to submit the material; that it is accurate where presented as fact; and that our permitted use will not infringe another person's rights, confidentiality or applicable law. Tell us clearly before submission if different terms, an embargo or confidentiality arrangement is proposed. MBJ is not bound by an unsolicited condition that it has not accepted in writing.
7. Prohibited use
You must not use the Service to:
- break the law, infringe rights, breach confidence or encourage unlawful activity;
- publish defamatory, threatening, hateful, discriminatory, sexually exploitative, fraudulent or deliberately deceptive material;
- harass, dox, impersonate or expose another person to a foreseeable safety risk;
- share unlawfully obtained confidential information, personal data, trade secrets or inside information;
- upload malware, probe security, bypass access controls, interfere with availability or abuse reporting systems;
- send spam, manipulate engagement, create deceptive accounts or use the Service for undisclosed coordinated influence;
- scrape, crawl, harvest, index or extract content at scale without permission, except for a conventional search engine acting in accordance with our technical instructions;
- use MBJ branding or content to imply endorsement, partnership or authorship without permission; or
- help another person carry out any prohibited act.
8. Moderation and content notices
We may review, label, restrict, remove, preserve or disclose user content, or suspend an account, where reasonably necessary to enforce these Terms, protect people or the Service, comply with law or respond to a sufficiently precise notice. We are not required to pre-screen every contribution and do not accept a general obligation to monitor.
To report allegedly illegal content, email legal@maltabusinessjournal.com with the exact URL, a clear explanation of the legal issue, supporting evidence and accurate contact details. Where applicable law requires it, we will acknowledge a valid notice, communicate a decision, provide a statement of reasons and explain an available review route. A contributor may challenge a moderation decision by replying to the decision notice with specific grounds.
9. Editorial content, corrections and opinions
We aim to publish accurate, fair and clearly labelled content, but news develops and honest errors may occur. Our Ethical Standardsexplain verification, corrections, right of reply and complaints. Opinion, analysis, interviews and contributed articles may contain the author's views and do not necessarily represent MBJ's position.
10. No professional or investment advice
Content is provided for general information and journalistic purposes. It is not legal, tax, accounting, medical, employment, financial or investment advice, and it is not an offer, recommendation or solicitation to buy or sell a product, security or service. Markets, laws, prices and company information can change. You should verify material information and obtain advice from an appropriately authorised professional before acting.
11. Third-party content, links and services
The Service may link to, embed or describe third-party websites, social networks, products, events or services. We do not control them and are not responsible for their availability, security, terms, privacy practices or claims. A link or mention is not an endorsement unless we expressly say so. Your dealings with a third party are between you and that party.
12. Advertising and sponsored content
The Service may contain paid advertising, affiliate links, partner branding and sponsored content. Commercial content will be identified using an appropriate label. Advertisers are responsible for their claims and compliance. Payment does not entitle an advertiser to control independent editorial coverage.
13. Newsletters and communications
If you subscribe, we may send the newsletters and optional communications you selected. You may unsubscribe using the link in a message. Operational or contractual messages may still be sent where necessary. Email delivery cannot be guaranteed and messages may be filtered, delayed or misdirected by systems outside our control.
14. Events, awards, promotions and paid services
An event, award, competition, subscription, ticket, research product or commercial campaign may have additional specific terms covering eligibility, price, VAT, payment, cancellation, judging, intellectual property, attendance, recordings or refunds. Those specific terms prevail for that activity if they conflict with these general Terms. Nothing limits mandatory consumer rights.
15. Availability and security
We may change, suspend or discontinue any part of the Service, introduce access limits or carry out maintenance. We do not promise uninterrupted, error-free or permanently archived access. You should use appropriate security, backups and judgement when downloading or relying on online material.
16. Disclaimers
To the fullest extent permitted by law, the free Service is provided ‘as is’ and ‘as available’. We do not give an absolute warranty that every item is complete, current, error-free, fit for a particular purpose or free from harmful components. This does not reduce the standards we voluntarily adopt under our Ethical Standards or exclude a warranty that cannot lawfully be excluded.
17. Limitation of liability
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, wilful misconduct, or any liability or consumer right that cannot lawfully be excluded or limited.
Subject to that paragraph and to the fullest extent permitted by law, MBJ is not liable for indirect or consequential loss, loss of profit, revenue, opportunity, goodwill, data or anticipated savings arising from use of the free Service or reliance on general editorial content. For a claim arising directly from a paid service, our aggregate liability is limited to the amount paid to MBJ for that service during the 12 months before the event giving rise to the claim, unless the specific written terms provide a different lawful limit. For the free Service, aggregate liability is limited to €100. These limits do not apply where mandatory law provides otherwise.
18. Responsibility for breach
You are responsible for reasonably foreseeable loss caused by your unlawful use or material breach of these Terms. If you use the Service for business purposes or submit content for publication, you agree, to the extent permitted by law, to indemnify MBJ against third-party claims and reasonable costs arising directly from material you supplied without the necessary rights or from your deliberate unlawful conduct. This clause does not apply to a consumer beyond what mandatory law permits.
19. Suspension and termination
You may stop using the Service at any time and may request account closure. We may restrict or terminate access where you materially or repeatedly breach these Terms, create legal or security risk, misuse the Service or where the feature ends. Where appropriate and lawful, we will give notice and a reason. Provisions that by nature should survive—including intellectual-property, archive, liability and dispute provisions—continue after termination.
20. Governing law and courts
These Terms and non-contractual obligations arising from them are governed by Maltese law. The courts of Malta have jurisdiction, except that a consumer retains any mandatory right to rely on the law or courts of the country of habitual residence. Before filing proceedings, the parties should make a reasonable attempt to resolve the issue directly, unless urgent relief is needed.
21. General
If a provision is held invalid or unenforceable, the remainder continues in effect and the provision will be applied to the maximum lawful extent. A delay in enforcing a right is not a waiver. You may not transfer your rights or obligations without our consent; we may transfer these Terms as part of a genuine restructuring or transfer of the Service, subject to applicable law. These Terms and any applicable specific terms form the entire agreement about the Service. The English version prevails to the extent permitted by law if a translation differs.
